These terms govern your use of luminyxeyewear.com and any purchase you make through it. By placing an order you agree to them. If you do not agree, please do not order.

Who we are

This store is operated by Luminyx. Throughout these terms, “we,” “us” and “Luminyx” refer to Luminyx; “you” refers to the person using the site or placing an order. Contact: info@luminyxeyewear.com.

Pre-orders

Items marked Pre-Order are not in stock. Placing a pre-order reserves a unit from a future production run and charges your payment method at the time of order. Estimated ship dates are estimates, not guarantees. Your cancellation and refund rights for pre-orders are set out in our cancellation and refund policy, which forms part of these terms.

Product information and specifications

We describe our products as accurately as we can. The NFS-1 is in development, and some specifications — including final battery runtime — are not yet finalised. Where a specification is not yet confirmed we say so rather than publishing a number we cannot stand behind. Final published specifications will be made available before shipping.

Colours and finishes shown in product photography may differ from the delivered product due to display and manufacturing variation.

Safety standards

The NFS-1 is engineered to ANSI Z87.1 impact-rated standards. Independent certification testing is in progress and has not yet completed. We will publish the certification status when it is finalised. Until then, do not treat any statement on this site as a claim of completed third-party certification.

Protective eyewear reduces risk; it does not eliminate it. Always select eye protection appropriate to your task and follow your employer's and jurisdiction's safety requirements.

Pricing and payment

Prices are shown in US dollars and may change without notice. We reserve the right to correct pricing errors and to refuse or cancel any order placed at an incorrect price, in which case we will notify you and refund you in full. Payment is processed by Shopify and its payment providers; we do not store your full card details.

Order acceptance

Your order is an offer to buy. We may accept or decline any order, including where we suspect fraud, where an item is unavailable, or where an order appears to be placed by a reseller without authorisation. If we decline your order after charging you, we refund you in full.

Intellectual property

The Luminyx name, logo, product designs, photography, and site content are our property or used under licence, and are protected by intellectual property law including patent protection on the illumination design. You may not copy, reproduce, or create derivative products from them without written permission.

Acceptable use

You agree not to use this site for any unlawful purpose, to attempt to gain unauthorised access to it, to interfere with its operation, or to scrape it at a volume that degrades service for others.

Third-party links and services

This site links to and relies on third-party services, including Shopify, payment providers, shipping carriers, and print-on-demand partners. We are not responsible for the content or practices of third-party sites.

Limitation of liability

To the maximum extent permitted by law, Luminyx is not liable for indirect, incidental, special, or consequential damages arising from your use of this site or our products. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or your statutory consumer rights.

Governing law

These terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-law provisions. This does not deprive you of the protection of mandatory consumer law in your country of residence.

Changes to these terms

We may update these terms. The version in effect when you place an order is the version that applies to that order. Material changes will be reflected in the “last updated” date above.
