Terms of Service
1. Agreement
These Terms of Service govern your use of luminyxeyewear.com and any purchase you make from it. The site is operated by Luminyx LLC, a Tennessee limited liability company ("Luminyx," "we," "us"). By using the site or placing an order, you agree to these terms. If you don't agree, don't use the site.
We may update these terms at any time. Changes take effect when posted. Your continued use of the site after a change means you accept it. Orders are governed by the terms in effect when the order was placed.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to purchase from us.
3. Products in development
The NFS-1 is currently in development and is offered as a pre-order. Product images on this site include renderings, prototypes, and pre-production samples.
Final production units may differ in cosmetic detail, finish, packaging, and non-essential features from what is shown. We will not materially reduce the core function of the product — integrated LED illumination in an impact-rated safety frame — without notifying pre-order customers and offering a full refund.
Specifications, including battery capacity, runtime, LED count, and weight, are subject to change during development.
4. Safety, eye protection, and intended use
Read this section carefully.
Luminyx products are designed to meet the impact requirements of ANSI/ISEA Z87.1. Certification testing is in progress and is not complete. We describe our products as impact-rated, not certified, and you should not rely on any representation to the contrary.
You are responsible for determining whether Luminyx eyewear is appropriate for your specific task, environment, and hazard. Eye protection is not universal — different hazards require different protection, including chemical splash, radiant energy, welding, laser, and high-velocity impact.
Luminyx eyewear does not replace:
- a hazard assessment required by your employer or by law
- protective equipment specified by OSHA, your employer, or a job site
- manufacturer instructions for tools or equipment you are using
Do not use our products for welding, laser work, or any application requiring a specific optical filter or shade rating unless the product is expressly rated for it. Inspect eyewear before each use and replace any product that is scratched, cracked, deformed, or otherwise damaged. Damaged eyewear may fail on impact.
Not a medical device. Luminyx products are not medical devices, are not FDA-cleared or approved for any diagnostic, surgical, or therapeutic purpose, and must not be relied on for any medical procedure or clinical decision. Any use in a medical, dental, or veterinary setting is at your own discretion and risk.
5. Batteries and electrical safety
Luminyx products contain rechargeable lithium-polymer batteries.
- Use only batteries and chargers supplied or expressly approved by Luminyx. Third-party cells may not match required specifications and can cause fire.
- Do not puncture, crush, disassemble, short-circuit, immerse, incinerate, or expose batteries to extreme heat.
- Stop using and safely isolate any battery that swells, leaks, discolors, deforms, or produces heat, odor, or smoke.
- Do not modify the product or its electronics. Modification voids any warranty and may create a fire or injury hazard.
- Dispose of batteries in accordance with local regulations. Do not place them in household waste.
- Lithium batteries are subject to shipping restrictions. Air travel with spare batteries is governed by carrier and TSA rules, which are your responsibility to follow.
6. Orders, pricing, and availability
All orders are offers to purchase and are subject to our acceptance. We may refuse or cancel any order for any reason, including suspected fraud, ordering errors, and product unavailability.
Prices are in US dollars and may change without notice. The pre-order price is a limited-time price offered before general availability and is not a permanent price.
We make every effort to display accurate pricing and product information, but errors occur. If a product is listed at an incorrect price, we may cancel the order and refund you in full, even after the order is confirmed.
7. Pre-orders, cancellation, returns, and shipping
Pre-orders are governed by our Pre-Order Cancellation Policy. Returns and refunds are governed by our Return and Refund Policy. Shipping is governed by our Shipping Policy. Each of those policies is incorporated into these terms.
8. Intellectual property
All content on this site — including text, images, renderings, video, logos, product designs, and the Luminyx name and marks — is owned by Luminyx LLC or its licensors and is protected by copyright, trademark, patent, and trade dress law.
Luminyx holds issued and pending patents covering circumambient illumination eyewear. Purchase of a product does not grant you any license to our intellectual property.
You may not copy, reproduce, reverse-engineer, or create derivative works from our products or content, or use our marks, without written permission.
9. Warranty disclaimer
Except for any express written limited warranty we provide with a product, the site and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that product descriptions are complete or current.
10. Limitation of liability
To the fullest extent permitted by law, Luminyx LLC and its members, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of the site or any product, under any theory of liability, even if we have been advised of the possibility.
Our total liability for any claim relating to a product or your use of the site will not exceed the amount you paid us for the product giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.
11. Indemnification
You agree to indemnify and hold harmless Luminyx LLC from any claim or demand, including reasonable attorneys' fees, arising from your breach of these terms, your misuse of a product, or your violation of any law or third-party right.
12. Prohibited uses
You may not use this site for any unlawful purpose, to solicit unlawful acts, to infringe our or anyone's intellectual property, to harass or discriminate, to submit false information, to upload malicious code, to scrape or harvest data, or to interfere with the security of the site.
13. Third-party links and services
The site may link to or rely on third-party sites and services, including payment processors and fulfillment partners. We are not responsible for their content, policies, or practices. Review their terms before using them.
14. Communications
By placing an order or providing your email address, you consent to receive transactional messages about your order. Marketing emails are separate and you may unsubscribe at any time. See our Privacy Policy.
15. Governing law
These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Any dispute not subject to another agreed process will be brought exclusively in the state or federal courts located in Davidson County, Tennessee, and you consent to their jurisdiction.
16. Severability and entire agreement
If any provision of these terms is found unenforceable, the remaining provisions stay in effect. These terms, together with our posted policies, constitute the entire agreement between you and Luminyx.
